QUICKLINK PROPRIETARY LICENSE Version 1.0, January 2025 TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION 1. Definitions "License" shall mean the terms and conditions for use, reproduction, and distribution. "Licensor" shall mean the copyright owner that is granting this License. "Legal Entity" shall mean the union of the acting entity and all other entities that control, are controlled by, or are under common control with that entity. "You" (or "Your") shall mean an individual or Legal Entity exercising permissions granted by this License. "Source" form shall mean the preferred form for making modifications. "Object" form shall mean any form resulting from mechanical transformation or translation of a Source form. "Work" shall mean the work of authorship, whether in Source or Object form, made available under the License. "Derivative Works" shall mean any work that is based on the Work. "Contribution" shall mean any work of authorship submitted to Licensor for inclusion in the Work. "Contributor" shall mean Licensor and any Legal Entity on behalf of which a Contribution has been received by Licensor and subsequently incorporated within the Work. 2. Grant of License Subject to the terms and conditions of this License, Licensor hereby grants You a worldwide, non-exclusive, royalty-free, non-transferable license to use the Work solely in binary object form, on hardware compatible with the ESP32 family of microcontrollers. 2.1 Permitted Use You may: - Use the Work (in binary Object form only) for personal, educational, and commercial projects - Distribute devices embedded with the Work (in binary Object form only) to end users - Modify Your own software to interact with the Work through its public API - Distribute the Work with Your own software, provided: a) You do not reverse engineer, decompile, or attempt to derive Source form b) You include a copy of this License with any distribution c) You clearly indicate any modifications made to Your software 2.2 Prohibited Uses You may NOT: - Reverse engineer, decompile, disassemble, or otherwise attempt to derive Source form - Remove or obscure any proprietary notices or labels on the Work - Redistribute the Work as a standalone library or component (except as permitted in Section 2.1) - Use the Work to create a competing product that provides similar provisioning functionality - Modify the Work itself or create derivative works of the Work in Source form - Sublicense the Work to third parties, except as embedded in Your end product - Use the Work to provide provisioning or networking services to third parties as a service offering 3. Redistribution The binary distribution package may be redistributed with software products built upon it, provided that: 3.1 Source Code - You do NOT have the right to distribute the Source form of the Work - You must not attempt to reconstruct or decompile the Source 3.2 License Notice - Any redistribution must include a prominent notice stating: "This product contains QuickLink technology. Copyright [Year] [Licensor]. Used under license." - A copy of this License must be included with all redistributions - Any modifications to Your software must be clearly documented 3.3 Binary Form - You may only redistribute the Work in binary Object form - The binary form must be used only on ESP32 family microcontrollers - You may distribute the binary as part of a compiled firmware image for ESP32 devices 4. Intellectual Property Rights 4.1 Ownership - Licensor retains all right, title, and interest in the Work - You retain all right, title, and interest in Your own software - Any modifications or additions are considered part of Your software, not the Work 4.2 Feedback - Any feedback, suggestions, or improvements You provide may be freely used by Licensor - Licensor is not obligated to include such feedback in the Work 5. Warranty and Disclaimer THE WORK IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE WORK. 6. Limitations 6.1 Term - This License is effective until terminated - Your rights under this License terminate automatically upon any breach of its terms - Upon termination, You must cease all use of the Work 6.2 No Warranty - Licensor makes no representation or warranty regarding the Work - Licensor assumes no liability for the fitness of the Work for any particular purpose 7. Governing Law This License shall be governed by and construed in accordance with the laws of the jurisdiction where Licensor is located, without regard to its conflict of law provisions. 8.
